Vol. 57 (2024), pp. 82-96. - Constanta : Technium Science, 2024 Note This scientific paper delves into the notable shift in Slovak labor law, which has departed from its historically strong emphasis on safeguarding the rights of employees, traditionally seen as the weaker party in labor relations. Until recently, this emphasis served as a substantial barrier against the globalizing and standardizing influences of employers. The paper identifies two key factors driving recent legislative "reforms" in Slovakia's labor regulation. Descr. články - journal articles Language English Country Romania Annotation This academic paper deals with current changes to Slovak legislation in connection with the transposition of the European directive on transparent and predictable working conditions. Both authors primarily concentrate on two newly established rights related to communication between employees, employee representatives, and employers and the right to electronic communication in the business sphere between the subjects of social relations, including the right to feedback. We pay specific attention in particular to the expected impact on applied practice, which often corresponds to the authors' legal considerations of de lege ferenda. The key paradigm of the author's interpretation consists in the analysis ofsuccess in introducing a new model of communication into the more or less traditionalist approach between the subjects of labour relations, including the impact on their rights and legitimate interests. Descr. články - journal articles Language English Country Romania Annotation The new legal framework introduces a novel concept of short-time work involving distinct features from the conventional system. The new Slovakian "kurzarbeit" model is intended to serve as a response to economic fluctuations and sudden interruptions of industrial or work processes. The legal analysis focuses on a comparison of the legal framework in the Short-time Work Support Act and the Slovak Labour Code, with regard to the partial duality of the legal regulation of this labour law institution. The authors aim to clarify the mechanism of functioning and anticipated impacts on the participants of labour relations. Descr. články - journal articles Language English Country Romania Annotation The legislation establishes a general principle for the employer with respect to prevention and assurance of health and safety at work, including the elimination of risks and factors that may lead to accidents at work, occupational diseases and other damage to health at work. The employer should prevent possible damage to the employee's health by taking various technical and organizational measures to protect the health of employees. In the conditions of the Slovak Republic, measures of this type include stays in institutions providing occupational healthcare. The scientific paper summarizes the substantive conditions of the employee's right to receive occupational therapy in institutional care, it points out the application shortcomings of the current legislation and, at the same time, criticizes the legislation adopted in connection with measures to prevent the spread of corona virus, which complicates the process of granting the employee their right to receive occupational therapy in institutional care. The aim is to provide scrutiny of this institute in the area of employee health and safety at work as a specific feature of the Slovak legislation.
